Mr. Rafferty brings experience as both a former prosecutor and defense attorney to his practice of white collar criminal litigation, criminal defense and commercial litigation.
As a former prosecutor, Mr. Rafferty conducted more than 20 trials, including cases involving allegations of vehicular homicide, rape, sodomy, robbery, burglary, narcotics possession and weapons possession. He tried the first murder case stemming from a DWI-related fatality in 25 years in Suffolk County and was awarded the Distinguished Trial Advocacy Award for Outstanding Felony Prosecution. Mr. Rafferty was also appointed Special Prosecutor for the investigation of the death of a Westchester County prosecutor.
As a defense attorney, Mr. Rafferty has worked on a variety of high-profile civil and criminal matters, including: the defense of the former head of Investment Banking of a major financial institution charged in connection with the collapse of Enron; the defense of the Sheriff's Department in the Columbine shooting investigation; the defense of an attorney in connection with a major fraud investigation involving the New York State court system; and the defense of an executive implicated in investigations by the SEC, New York Attorney General, and the Department of Justice into late trading and market timing of mutual funds.
He is admitted to practice in New York State and the United States District Courts for the Southern District of New York and the Western District of New York. He has lectured at the National Conference of Secondary School and Collegiate Officials on legal issues in premises security litigation and for the Suffolk County Criminal Bar Association on the prosecution and defense of vehicular homicide cases. Mr. Rafferty has also attended courses on gang prosecutions, DNA evidence and technical cross-examination, at the National Advocacy Center in South Carolina.
He received his J.D. from Vanderbilt University Law School in 1996 and received a double major in English and Government/Law from Lafayette College in 1993.
Mr. Rafferty is a volunteer at the Children's Specialized Hospital in Mountainside, New Jersey. Mr. Rafferty enjoys golf, marathon running, soccer and fishing.
